In 1885 Carl Lehman and John Dube purchased 4,000 acres of the Absolem C. Delaplain league on behalf of the group of more than 500 Wends, who under the leadership of Pastor John Kilian, qv immigrated from Lusatia to Texas in 1854, forming the mother colony of Wends qv in Texas. They subdivided the tract into farms and town lots which they sold to individuals. Kilian Lutheran congregation bought ninety-five acres for a church and school. The community on the old Gotcher Trace was called Low Pin Oak Settlement, and by 1857 fifty families were reported living in the vicinity. When the town received a post office in 1860 the name was changed to Serbin (Wendish Land). Society of Sisters , where the United States Supreme Court concluded that parents have the fundamental right to direct the upbringing and education of their children.1 Yet, when parents, especially low-income parents, are faced with the options of sending their children to a public school that may not, for whatever reason, be meeting their childrens educational needs or spending thousands of dollars for private school or home-schooling, it is fair to say that parents are indeed forced to choose public school.2 Parental choice programs, or educational vouchers, surfaced as a potential solution to this problem. In 1998 and 1999, 32 states considered school choice, and 45 governors stated support for some degree of school choice or charter schools.3 Under the basic school choice program, parents would receive a certain dollar amount from the state and apply that amount to the school the parents find best suited to educate their child, be it private, public or parochial. In examining such a program, two issues deserving of attention include the constitutionality of the educational choice program and the administrative and pedagogical effects. Constitutionality Under the United States Constitution The United States Constitution does not expressly provide for or prohibit an educational voucher system that would allow parents to send their children to parochial schools, but past decisions by the United States Supreme Court indicate school choice programs that include religious schools are constitutional, at least under the federal constitution.4
