Extractions: UT Law UT UT Libraries Home ... Printable version Prepared by Beth Youngdale Researching the law on a particular topic is generally a multi-step process that involves checking a number of sources - statutes, cases, and, sometimes, administrative rules or regulations. Very rarely is there a simple answer to a legal question or a single book that will provide an answer. Discovering what the law is in a given situation means finding the rule that is applicable - usually a statute, or in some instances a case - and then applying the rule to the facts of the situation. Case law is generally used to see how courts have applied the rule in other situations. The key is finding a case with facts that are analogous to your own. Where you start depends largely on what information you already have about the area of law you are researching. If you already have a citation - to a statute or a case - you are, to a certain extent, ahead of the game. Statutes and cases provide excellent jumping off points to additional sources of the law. If you don't have a citation, or are unfamiliar with an area of law, secondary sources are a good place to start. These sources, which are not the law, provide background information, an introduction to the terminology of a particular topic, and valuable citations to primary sources of law (statutes, cases, administrative rules).

Extractions: Spoliation of Evidence: A Survey of Texas Law Oliver Wendell Holmes once said that "[t]he law embodies the story of a nation's development through many centuries, and it cannot be dealt with as if it contained only the axioms and corollaries of a book of mathematics." Unfortunately, this statement accurately describes the current Texas law on spoliation of evidence in that there are few hard and fast rules concerning the destruction of evidence. The best way to determine the law in your jurisdiction is to review the specific history of the court you are in. A. What is Spoliation? Though the Texas Supreme Court has not defined the term spoliation and different jurisdictions have applied different definitions to the term, the term broadly refers to the intentional, reckless, or negligent destruction, loss, material alteration or obstruction of evidence that is relevant to litigation. It is, however, still unclear if spoliation includes both negligent and intentional destruction of evidence, the loss of evidence, and/or evidence that was destroyed before litigation began. B. Extractions: Civil Process and Liability (12 hrs.) Unit Goal: The student will understand the liability assumed resulting from improper acts or failure to act in the execution of civil process and/or other daily law enforcement duties. Recognize that peace officers and the entity that employs them are liable for improper acts likely resulting in civil action. The potential for civil liability in any action a peace officer takes has greatly increased in recent years. When an alleged civil wrong occurs, the civil action is not usually limited to just the individual officer, but also involves the agency or political sub-division that represents the commissioning authority of the officer. A great emphasis has been placed on initial and continuing training of peace officers as a defense when a question arises out of an action that could result in a lawsuit. Governmental entities are very vulnerable to the decisions and remedies imposed by the courts, when found to be liable for actions of peace officer(s), resulting in stringent hiring requirements, basic training and continued update and in-service training. Listed below are some acts that commonly result in civil action: Civil Rights Violations Official misconduct Wrongful death Sexual Harassment Discrimination matters;
