This time limitation is known as the statute of limitations. Simply, a statute of limitation is the duration of time provided by law in which one party may assert a legal claim against another party. Such limitations assure an end to litigation and . . . establish a state of stability. LaBarbera v. Batsch, 10 Ohio St. 2d 106 (1967). Claims filed after the appropriate statute of limitations expires are dismissed. The Individuals with Disabilities Education Act (IDEA) is a federal law and while most federal rights created by Congress prescribe a specific period for their enforcement, IDEA does not. According to the US Supreme Court in Wilson v. Garcia, 471 U.S. 261 (1985), federal courts in such cases will determine which state cause of action is most similar to the federal cause of action and will borrow the period of limitation for that action if it is consistent with the policy of the federal cause of action. According to the Sixth Circuit Court of Appeals, the appropriate statute of limitations for IDEA claims must be determined on a case-by-case basis. Janzen v. Knox County Bd. of Educ., 790 F.2d 484, 486-487 (6th Cir. 1986). This is because no single state statute of limitations applies to all situations; no one state law neatly encompasses the various actions that can be brought under the IDEA, which range from actions for reimbursement for a private placement to challenges to the propriety of an individualized education plan. Extractions: Reading Recovery in Southern Rhode Island After a brief lapse in service, the Southern Rhode Island Collaborative has once again put the Reading Recovery intervention into the offerings to schools and school districts. Rhode Island has developed a consortium of sites to serve the State in the various regions. Because of the definite need in the area of reading and writing and the devotion of many advocates, the intervention has once again been reinstated in this area with hiring of a Teacher Leader in the Southern Rhode Island region. Patricia Starnes comes to us after working several years in Reading Recovery. She was trained by Billie Askew at Texas Woman's University and continued to work as a Teacher Leader in South Texas, Connecticut, and Massachusetts. While in Massachusetts, she worked directly under Irene Fountas at Lesley University and received further training as a trainer of Literacy Coordinators for the Literacy Collaborative (formerly ELLI). Starnes' bilingual proficiency led her to be involved in Descubreindo La Lectura, a Spanish reconstruction of Reading Recovery and the development of materials for use in Literacy Collaborative classrooms where children are learning to read in Spanish. Reading Recovery is a valuable service that schools provide for first grade children who are struggling in reading and writing. The intervention targets children before they have fallen into a cycle of failure and the majority of them become successful readers and writers. Actually, the program has two positive outcomes. The children who are unable to meet the average range of performance within 20 weeks of service are then clearly identified as needing Special Education services. This allows for better identification of the Special Education population and the children's programs can be more readily identified.

One of the more frequently asked questions relates to phone-bill charges, such as the Telecommunications Infrastructure Fund (TIF) and the Texas Universal Service Fund (TUSF). There has been some confusion about the difference between the TIF and the TUSF. These funds are separate entities; however, both are assessments against telecommunication-service providers. All service providers, including wireless, pager, local and long distance telephone companies, must pay the TUSF assessment. They have the option of passing the charge on to their customers, and most do. In 1987 when the Texas Legislature established the Universal Service Funding mechanism, the charges were included in the phone bill. Because of legislative action in 1999, the charges are listed separately as TX USF CHARGE. Approximately 90 percent of the fund helps local telephone companies provide service in high-cost rural areas. Without assistance from the TUSF, a son living in a city might have difficulty checking on his elderly father who insists on living alone on a remote ranch. Without the TUSF, the cost of running phone lines to rural areas would be prohibitive.
