The test may be the test provided by the South Dakota and used in the public school district where the child is instructed or another nationally standarized achievement test chosen by and provided at the expense of the child's parent, guardian, or school giving alternative instruction. The test may be monitored by the local school district where the child is instructed.

(34.300-39A) FBA Definitions and Purpose Although the term "functional behavior analysis" was added to federal regulations, the definition for FBA was not defined in the statute, and the U. S. Department of Education has been reluctant to supply a regulatory definition (Gorn, 1999). In the Answer Book on Discipline , Susan Gorn (1999) cites information from the federal register that this lack of definition was meant to allow the IEP team to consider on a case-by-case basis, the "situational, environmental and behavioral circumstances" (p. 4:12) in the design of appropriate assessment. She believes, as do others (Tilly et al., 1999; Quinn et al., 1998), that Congress intended for educators to apply the definition for FBA commonly used by educational psychologists and other behaviorists (Gorn, 1999).

In 1997, the South Dakota Pharmacy Association leadership helped pass legislation against requiring pharmacy access to EC. Many, if not most, pharmacies do not stock dedicated EC products. Planned Parenthood launched a media and mail campaign [see press release (PDF-448K) and press coverage, 4/18/03 (PDF-70K) 4/10/03 (PDF-508K) 4/9/03 (PDF-476K) ] to raise awareness around EC. They are planning to do an educational mailing to physicians and an education campaign to pharmacists in late 2003. The South Dakota NARAL Educational Fund surveyed hospitals to determine access to EC in the ER and signatures are currently being gathered to petition the legislature to require EC in the ER. The Educational Fund may also conduct a survey of pharmacies once the hospital survey is published.
