This is a tremendous victory for womens health, said Denise Burke, staff counsel with Americans United for Life. Despite repeated attempts by pro-abortion advocates to derail these regulations, the Fourth Circuit has recognized, yet again, the right of individual states to ensure that women are not receiving substandard medical care at abortion clinics. This was the second time that the Fourth Circuit was asked to review South Carolinas regulations. In August 2000, the appellate court upheld the regulations against claims that they unduly burdened a womans right to choose an abortion and that they violated constitutional guarantees of equal protection. The U.S. Supreme Court declined to review the case, tacitly affirming the Fourth Circuits decision, in February 2001. The case was then returned to the federal district court in Greenville, South Carolina where abortion providers sought and received rulings on remaining challenges to the regulations. After a second hearing on April 5, 2002, the Fourth Circuit summarily rejected claims by abortion providers that the regulations were unconstitutionally vague and that they illegally delegated state authority to private and state hospitals by requiring abortion providers to have admitting privileges at a local hospital. The court also rejected claims that a requirement that clergy be made available to counsel women, if requested, violated the doctrine of separation of church and state and that allowing state officials to review patient records, in the ordinary course of their duties, violated patients informational privacy rights.

States have the right to ensure that women receive safe, competent medical care and that is exactly what abortion clinic regulations are designed to do." The Supreme Court's refusal to hear this case will have an immediate impact on other states that have passed or are considering similar licensing and regulatory requirements for abortion clinics. Regulations in three other states (Arizona, Texas, and Tennessee) are currently facing legal challenges by abortion providers. "This decision solidifies constitutional support for the regulation of abortion clinics and ensures that other states will consider enacting similar regulations," said Burke.
