An Indian tribe is a body of Indians of the same or similar race united in a community under one leadership or government, and inhabiting a particular territory. The term "tribe" is not always used with this meaning. It is sometimes used interchangeably with "nation" or "subtribe." The term may vary from statute to statute as well. To determine whether a group has maintained tribal relations and structure to constitute a tribe, courts and legislatures examine many factors such as the extent of Indian governmental control over their lives and activities, and the extent to which the group exercises political control over specific territory. If you have been the subject of an arrest by the police or other state or federal official which took place without probable cause, in bad faith or if someone deprived you of your liberty, you may be able to make a claim and recover damages, including attorney's fees and costs. Your rights are safeguarded by both the United States Constitution and state common law. False imprisonment is frequently alleged by a person who feels that he or she was unlawfully arrested. If the police did not have "probable cause" to arrest you, you can sue for false imprisonment. "False arrest" is really just a type of false imprisonment. The police have probable cause when there are enough facts to lead a reasonable person to conclude that you are committing or have committed a crime. This is a considerably higher standard than the mere "suspicion" an officer needs in order to stop you briefly to investigate possible criminal activity. Assistant Attorney General for Civil Rights Alex Acosta said government lawyers would support 11-year-old Nashala Hearn, a sixth-grade student who has sued the Muskogee, Oklahoma, Public School District for ordering her to remove her head scarf, or hijab, because it violated the dress code of the Benjamin Franklin Science Academy, which she attended. The girl continued to wear her hijab to school and was subsequently suspended twice for doing so. The family appealed the suspensions, which were upheld by a district administrative hearing committee.

Your Internet e-mail address: March 11, 1998 DIVORCE SEMINAR REQUIREMENT UPHELD The Oklahoma Supreme Court has upheld the constitutionality of requiring divorcing parents in Oklahoma to attend the "Helping Children Cope with Divorce" seminars. In Nelson v. Nelson , decided February 3, 1998, the husband was served with a divorce petition which notified him of his obligation to attend the seminar. Husband failed to answer the petition, and did not attend the seminar. In granting a default divorce, the court denied visitation to the husband, based upon his failure to attend. On appeal, the husband argued that the requirement of attending the seminar was a violation of equal protection and due process. The Supreme Court denied the equal protection challenge, on the basis that the requirement applies to all divorcing parents, and is intended as a protection for children of divorcing parents. The court further held that the simple requirement that divorcing parents attend the seminar was not a violation of due process, however, since nothing in the papers which were served on the husband notified the husband that he could be denied visitation based on his failure to attend, the court held that the trial court should have vacated its earlier decree when challenged by the husband.
