Unfortunately, each state has their own rules about collection of child support, and you may need to speak to an attorney licensed in that state. An attorney licensed only in California, or New York, or Florida, can only answer questions regarding the law in the state they are licensed, and unfortunately, there is no simple answer since each state is free to make up their own rules for enforcement. Also, part of the requirements of the bar in each individual state is a rule that an attorney licensed in one state shall not give legal advise regarding the laws of another state unless they are licensed in that state. An attorney can be sanctioned by their own bar for failure to follow these ethical rules. So, if your matter is pending in some other state, take advantage of the research we have done. Contact one of the attorney referral services listed below, or nationwide organizations listed. Do not contact us, because you will most likely get a response that reiterates the bar rules of the state of California. Extractions: Grandparents and Other Relatives Raising Children A State Fact Sheet August 2002 Across the country, more than six million children approximately 1 in 12 children are living in households headed by grandparents or other relatives. North Dakota has more than 113,000 children living in households headed by grandparents or other relatives. In many of these households, grandparents and other relatives are the primary caregivers (kinship caregivers) for children whose parents cannot or will not care for them due to substance abuse, illness and death, abuse and neglect, economic hardship, incarceration, divorce, domestic violence, and other family and community crises. In response to the growing numbers of these kinship care families, state legislatures, public and private agencies, and grassroots coalitions in North Dakota and across the country have begun to expand services and supports for children living with kin inside and outside of the foster care system. A Look at the Numbers: Kinship Care in North Dakota The data below show the numbers of grandparents who are living in households with at least one grandchild under the age of 18, as well as the numbers of grandparents who are the primary caregivers for these grandchildren. These numbers were reported by the 2000 U.S. Census and are available for every place (as defined by the U.S. Census Bureau) in the country, including cities, towns, villages, and boroughs, on the U.S. Census website.*
