This time limitation is known as the statute of limitations. Simply, a statute of limitation is the duration of time provided by law in which one party may assert a legal claim against another party. Such limitations assure an end to litigation and . . . establish a state of stability. LaBarbera v. Batsch, 10 Ohio St. 2d 106 (1967). Claims filed after the appropriate statute of limitations expires are dismissed. The Individuals with Disabilities Education Act (IDEA) is a federal law and while most federal rights created by Congress prescribe a specific period for their enforcement, IDEA does not. According to the US Supreme Court in Wilson v. Garcia, 471 U.S. 261 (1985), federal courts in such cases will determine which state cause of action is most similar to the federal cause of action and will borrow the period of limitation for that action if it is consistent with the policy of the federal cause of action. According to the Sixth Circuit Court of Appeals, the appropriate statute of limitations for IDEA claims must be determined on a case-by-case basis. Janzen v. Knox County Bd. of Educ., 790 F.2d 484, 486-487 (6th Cir. 1986). This is because no single state statute of limitations applies to all situations; no one state law neatly encompasses the various actions that can be brought under the IDEA, which range from actions for reimbursement for a private placement to challenges to the propriety of an individualized education plan. This system has been used in a number of communities in California to improve oral health for people with special needs. It includes oral health assessment, coalition building, development and networking of local resources, training of dental professionals, and utilization of preventive dentistry training materials. Also discussed are challenges of the future that will need to be met to continue to make oral health a priority and reality for people with special needs in California. Journal of the California Dental Association In California, inadequate access to medical and dental care for people with special needs remains a significant problem. In this context, "special needs" refers to medical, social, psychological, or physical conditions that make it necessary to modify the normal course of dental treatment. Examples of such conditions include medical and developmental disabilities; problems associated with aging; and psychological problems, including dental phobia. Individuals with such conditions have been termed "special patients."1 In studies of special patients, such as people with developmental disabilities residing in community settings, it has been reported that these individuals have significant unmet medical needs in general,2-6 as well as significant unmet dental needs.7-11 These findings are even worse for individuals with disabilities who are living in rural areas of our country,12 and conditions are further complicated by the increasing trend to move individuals with severe disabilities out of institutions. Many individuals have been moved into community living situations with inadequate arrangements for medical and dental services.4-6

Now it appears that Missouri may be kept where she is or moved only a short distance away. The preference in this corner is that Missouri remain in place or be moved to a spot within sight of the Arizona Memorial. In addition, the two memorials should be integrated into a grand national monument by the National Park Service, the Missouri Memorial Association and the United States Navy. The park service administers the Arizona Memorial; the Missouri association is a private, nonprofit group; and the Navy supports them both. A combined Arizona-Missouri memorial could be arranged with relative ease, even with bureaucratic obstacles to be overcome. It would begin with a revision of the movie shown at the Arizona visitor's center that depicts the Japanese surprise attack on Dec. 7, 1941. The narrative would move swiftly from that day through a summary of the war in the Pacific and end with the ceremony in which the Japanese surrendered aboard Missouri at anchor in Tokyo Bay on Sept. 2, 1945. Then visitors would be taken by a Navy shuttle boat, as now, across the harbor to the graceful white bridge spanning the sunken Arizona. After that, they would again board the shuttle boat to go directly to Missouri. When that tour was finished, the shuttle boat would return to the visitor's center. This journey would eliminate the present cumbersome bus ride from the visitor's center around to Ford Island.
