But the Gasperini case, which some say could be the term's sleeper, offers a new twist on that familiar debate about runaway juries. It asks a fundamental and surprisingly still unsettled question of constitutional law: Does the Seventh Amendment's re-examination clause prohibit federal appellate courts from doing what most believe they have had the authority to do for at least 50 yearsreview jury verdicts for excessiveness?

Extractions: HISTORY OF THE CALIFORNIA CODE OF CIVIL PROCEDURE By JUSTIN MILLER* Of the Los Angeles Bar [Produced with Permission (23 West's Annotated California Codes 1-44 (1955))] The Code of Civil Procedure of California as it appears in its present form is more law than constituted the entire library of many a California lawyer prior to the enactment of the Practice Act of 1851. That Act contained section numbers running from 1 to 642, and constituted a very small volume of approximately 100 pages. The Practice Act was amended frequently until in 1870 a complete revision was undertaken. In 1872 the Code of Civil Procedure, so named, came into existence. Dissatisfaction with its provisions was immediately revealed and the business of amendment started again. Each session of the Legislature added, subtracted, modified. Several revisions were undertaken; several commissions labored. Finally, it appeared in its present form. The history of this development is an interesting one, not only from the legal point of view, but because of the political, economic and social implications involved. Fortunately, there were strong men in those days, with the attributes of real citizenship. Before California became a State, it was under military government, but that government had little influence except along the seaboard. The mining camps in the Mother Lode of the Sierra Nevada mountains and in the far northern reaches of the Coast Range knew little and cared less about the proclamations of the military governors.

Extractions: On behalf of our long-time client Paralyzed Veterans of America (PVA), we filed an amicus curiae brief in this case in the Eleventh Circuit, addressing both the private right of action and remedies issues.
