In CIBC v. Isobord Enterprises Inc. , the Manitoba Court of Queen's Bench found the government department failed to comply with Manitoba's statutory scheme for issuing an environmental order, in this case an order to develop and implement a rodent control order. The department did not pay attention to the statutory requirements to establish that an emergency situation existed or, alternatively, to obtain court authorization to issue the order.
