With respect to the amendments related to Elements 1.1 (accountability for schools without tested grades) and 7.1 (graduation rate definition), Maine may make these changes. With respect to Element 5.5, Maine wishes to apply a confidence interval to safe harbor determinations. Maine may use this statistical test (limited to a 75% confidence interval) for making adequate yearly progress (AYP) determinations this school year. We request, however, that Maine provide impact data from the 2002-2003 AYP data regarding the use of this statistical test for "safe harbor," as soon as it is available, for further review and consideration by the Department. Please update your accountability plan with these amendments and submit it to your state contact so that the most up-to-date plan is available and on the Department's website.

Extractions: The impacts of assistive technology (AT) are multidimensional, multifaceted and cross every domain of life. Perhaps Morris and Button (1994) answered the question best when they reported in "Access to Assistive Technology: A Public Policy Status Report" that "for some individuals with disabilities, assistive technology is a necessity that enables them to engage in or perform many tasks... to have greater control over their own lives; participate in and contribute more fully in activities in their home, school, and work environments, and in their communities; interact to a greater extent with non disabled individuals and otherwise benefit from opportunities that are taken for granted by individuals who do not have disabilities" (P. L. 103-218, Section 3). The Individuals with Disabilities Education Act Amendments of 1997 (IDEA) (P. L. 105-17) is the federal law that mandates a free appropriate public education (FAPE) in the least restrictive environment (LRE) to children and youth with disabilities. IDEA requires special education services be provided for children and youth with disabilities aged 3 to 21 and early intervention services for children with disabilities birth through 2. The Assistive Technology Act of 1998 (ATA) recognizes the importance of assistive technology in the lives of individuals with disabilities. Assistive Technology is defined as "any item, piece of equipment, or product system, whether acquired commercially modified or customized, that is used to increase, maintain, or improve the functional capabilities of individuals with disabilities" (P. L. 105-394, Section 3). Identical definitions of AT are found in both the IDEA and ATA. The only exception is the use of "child" in IDEA and "individual" in the ATA.

Extractions: Blethen Maine Newspapers Inc. W ITH THE STATE'S PRESIDENTIAL PRIMARY on March 5 approaching, the attention of many Maine citizens has turned to the issues that most affect their lives. In particular, the 50 or so Sanford residents taking part in the Maine Citizens' Campaign have been thinking and talking about education in America. They want to know what the next president will do to improve it, and at what cost. The residents, a collection of homemakers, educators, engineers, nurses, farmers and a few who have no job, seem not to want more government involvement in public schools, but do see a need for bold leadership on the issue. The Maine Citizens' Campaign, an example of civic journalism, is intended to give ordinary citizens a greater voice in the 1996 presidential campaign. The yearlong voter project is a collaborative effort of The Portland Newspapers, WGME-TV , Maine Public Broadcasting, and the Roundtable Center. In the coming months, the residents of Sanford, a former mill town in southwest Maine, will continue to meet to discuss the issues they consider the most important. At the group's first meeting in November, the participants selected education as their No. 1 concern.

Extractions: The December 11 School Committee meeting included a presentation by Curriculum Director Mary Patrick and BRHS (Boothbay Region High School) Principal Jack Tourtillotte on the new federal regulations for high schools regarding graduation requirements. These regulations are the result of 15 years worth of teacher input. As an introduction to the presentation Tourtillotte related the history behind the Maine State Learning Results. The idea behind the Maine Learning Results, developed by the state, was to devise a set of goals that every high school graduate was to meet. There was debate within public forums across the state and the state legislature on what these goals should be. An example of one of the Learning Results is: every high school graduate will be an effective communicator and be able to demonstrate that ability. This learning result (and all others) were then assigned a set of 8 - 10 standards or indicators determining how students would achieve such an ability. After the Results became law, the state then required schools to ensure the Results were being carried out through documentation. A year ago, Chapter 127 was revised to align the Chapter's rules with the Maine State Learning Results. This year's eighth grade class will be the first class affected by the revised rules of Chapter 127 for graduation in 2007.
