Tenbusch, Planner I, St. Lawrence County Planning Office April, 1999 Fair housing is the law: it involves legal protection when housing choice is restricted on the basis of race, color, national origin, sex, religion, handicap or other protected class. Both intentional discrimination and actions and conditions that have the effect of limiting choice are prohibited. In order to obtain local compliance with Federal law, the Department of Housing and Urban Development (HUD) has had a long-standing mandate requiring state and local jurisdictions and housing providers receiving HUD funds to meet certain standards or take specific actions to affirmatively further fair housing. These have included passage of local fair housing laws, fair housing marketing requirements, tenant selection and assignment criteria, program accessibility, reasonable accommodations, and other activities. HUD requires local communities to certify that they affirmatively further fair housing as a condition of receiving Federal funds; HUD defines this obligation as requiring the grantee to conduct an analysis to identify impediments to fair housing choice within the community; take appropriate actions to overcome the effects of identified impediments; and to maintain records concerning the local analysis and activities.

Students represent low income families on their housing-related legal problems. The primary focus of the work is helping clients (1) avoid homelessness and (2) access affordable housing. Thus, a good deal of the work involves representation of clients in threatened evictions and in denials of public housing, subsidized housing and Section 8 housing. The clinic also involves representation of clients in other aspects of landlord-tenant law. Some opportunity exists for real estate related work on behalf of individuals and community-based nonprofit groups. In the past students have drafted deeds, earnest money contracts, affidavits of heirship and leases. Students are responsible for interviewing clients, investigating their cases, researching legal issues, negotiating with opposing parties, drafting pleadings and discovery in eviction cases, and representing clients at administrative hearings and in court. Although a good deal of the work has a litigation bent (e.g., negotiation, drafting pleadings and discovery), actual court representation has been limited in the past with students successfully settling their cases. (Four federal court lawsuits have been filed by Clinic students during the past three years, with students drafting the complaints and completing discovery during the semester.)
