Extractions: THE GOOD SAMARITAN LEGISLATION The Year 2000 problems, commonly referred to as "Y2K compliance" or "the Millennium bug" have the potential to cause significant disruption socially and economically. The extent of the disruption has been the subject of a lot of argument. While many businesses have a good idea of the problems associated with the Year 2000 date change and how to remedy them, other businesses need assistance. It is generally thought that open communication on Y2K problems will be to the benefit of all. The difficulty to date has been that some businesses fear that if they disclose information such as test results on systems, others acting on the information may sue them for negligence in the event that the information turns out to be wrong. This is hindering the willingness of larger businesses to assist smaller ones. Accordingly, New Zealand has enacted the Y2K Information Disclosure Act 1999, nick named "The Good Samaritan" Act. The Act took effect from 15 May 1999. The aim of the Act is to promote the disclosure and exchange of information relating to Y2K issues which would enable businesses to improve their Year 2000 readiness. It is expected that the sharing of information between businesses will help a smooth transition into the new millennium.

The continual progress in Y2K preparations, testing and contingency planning has enabled the financial industry and its regulators to report a steady stream of good news. These communications efforts have paid off. A November report on a Gallup poll sponsored by the Fed and the FDIC indicates that nine out of 10 U.S. bank customers believe that their banks are ready for the Year 2000. Of those surveyed, nearly 70 percent report that they are receiving Y2K-related information from their financial institutions. Most important, the survey also reveals that only 39 percent of the respondents plan to withdraw extra cash prior to the New Yeardown from 62 percent in March. The Gallup results underscore the tremendous effort that the financial industry has made to communicate Y2K readiness. But while public confidence is moving in the right direction, the task is not quite finished. Fed Gov. Edward W. Kelley Jr. has said that we face two challenges related to the Y2K problem-preparing our technical systems and gaining public confidence. With 99.9 percent of all U.S. depository institutions deemed ready, it appears we have mastered the technical hurdle. The Gallup survey indicates weave turned the corner on public confidence as well. But public confidence can change quickly, especially if rumors and speculation go unchecked.

Within the field of computing the Y2k problem has been known for a long time. Already back in the 70's, banks and insurance companies were able to establish the fact that the change of year from 1999 to 2000 would cause problems when calculating life insurance policies and long-term mortgages. lt was always necessary to take special measures to account for the millennium change in these calculations. The main cause of the problem was that computer memory was rare and expensive back then, so everyone used two rather than four digits to store years. The consequence was of course that the year 2000 came up as 00 in two-digit calculations, and this gave rise to a number of calculation errors, e.g. division by zero. However, things get even more complicated. Not only will the change-over as such cause problems, but it is further complicated by the fact that year 2000 is a leap year of a type which only appears every 400 years. A number of different program routines are used to calculate leap years. Since long product life cycles are not exactly the norm in the computer industry, it stands to reason that the short versions of leap year routines prevail. These will correctly calculate leap years in 100-year spans but do not take the special situation arising every 400 years into consideration. Thus, they do not recognise year 2000 as a leap year.

More recently, the Ministry of Justice has issued Ordinance No. 212, and the Secretary of Administration and Patrimony has issued Ordinance No. 601. Both of these Ordinances were published in the Federal Official Gazette on May 17, 1999, and regulate Y2K issues within the scope of these government agencies' areas of control. Ordinance No. 212 is addressed to the Consumer Protection and Defense Department of the Economic Rights Secretariat of the Ministry of Justice ("Department") and directs the agency to take all necessary actions to protect consumer rights in light of Y2K potential problems. In summary, Ordinance No. 212 directs the Department to alert consumers to the problems that may be caused by Y2K. The Department is also required to identify the liability of manufacturers and suppliers of both goods and services for damages that may be caused by Y2K, and to inform suppliers of goods and services that as of May 17, 1999, contracts, packages or instruction manuals must clearly state that relevant goods and services are Y2K compliant or, alternatively, the term, form and place where the goods and services will be made compliant (without cost to consumers).
