Pro bono comes from the Latin "pro bono publico" and means "for the public good." In a law school setting, pro bono may have many meanings. For the practice setting, the American Bar Association (ABA) has set forth a lawyers pro bono responsibility in Model Rule 6.1 , which encourages lawyers to aspire to render at least 50 hours of pro bono legal services per year without fee or expectation of fee to persons of limited means or to organizations designed primarily to address the needs of persons of limited means. With the legal professions core value of access to justice for all as a backdrop, the ABA, representing the bar, and the Association of American Law Schools (AALS), representing the law school community, have taken the position that law schools should encourage and enable all law students to engage in pro bono and public service. In 1996, the ABA amended its Accreditation Standards to provide that "[a] law school should encourage its students to participate in pro bono activities and provide opportunities for them to do so."

In early 2003, the United States Supreme Court issued an order in the Texas case, similar to a decision involving the Washington IOLTA program, which rejected the argument that IOLTA violates the Fifth Amendment prohibition against takings without just compensation. IOLTA generates over $100 million per year nationwide for legal services programs. The firm continues to represent the two IOLTA programs on remaining claims that IOLTA violates the First Amendment. In the Massachusetts case two Hale and Dorr attorneys have been appointed special assistant attorneys general to represent the IOLTA program and the justices of the Supreme Judicial Court. Hale and Dorr continues to represent an Alabama death row inmate in his state and federal post-conviction proceedings. The inmate is a mentally retarded, Louisiana native incarcerated on death row at Holman Prison in Atmore, Alabama.
