This paper is not meant to be a comprehensive guide to information on indigenous people. It is meant to be a guide to researching international law and indigenous peoples rights. Since this paper was finished, S James Anaya has published an excellent treatise on this area, Indigenous Peoples in International Law , New York, Oxford: Oxford University Press, 1996, (ISBN 0-19-508620-1), which is recommended reading for anyone interested in the legal treatment of indigenous peoples. As is mentioned below, this paper was originally delivered as part of a program on indigenous peoples rights. Another speaker covered American Indians. Because of that, this paper's coverage of American Indians is limited.

Extractions: Tree Services If you own your garden you may think that you can do what you like in it. That is not the case. There are restrictions both private and statutory e.g. your deeds might say that you must keep the front garden open plan, and not erect boundaries of any kind be they fences, hedges or walls. Planning laws may say that you cannot use the garden for particular purposes; you may have an obligation even towards trespassers, let alone lawful visitors. A tree in your garden may the subject of a Tree Preservation Order preventing you from even gardening as you might wish. Ownership of land generally gives you the right to the air space above it to a height which is necessary for you to fully use your land and the right to the materials underneath the soil. Again your deeds may say that the mineral rights belong to someone else e.g. an earlier owner or the successors to the National Coal Board. What is true is that if someone infringes your air space e.g. by a hoarding that overhangs your land, or they make an entry into your garden below the surface e.g. drainage pipes or tree roots, then that is a trespass. There are exceptions to the rules e.g. military aircraft; civil aircraft which fly at a reasonable height. Gold and Silver belongs to the crown as do petroleum and natural gas existing in strata.
