Extractions: Domestic Violence Legal Issues Should be Incorporated Throughout Law School Curricula Domestic violence legal issues should be incorporated into law school curricula as a core component of legal education. It may be easy to understand the benefits of raising these issues in clinical programs, which train students to represent or assist victims in the community. A more subtle need, however, is to alert lawyers to the ways in which domestic violence issues crop up in seemingly unrelated fields of law. Lawyers who practice any kind of family, criminal, tort, financial (including wills, trusts and estates, and tax law) or poverty law are likely to have cases complicated by domestic violence. Understanding how to spot domestic violence issues will assist lawyers to represent clients properly. Therefore, these issues must be raised not only in specialized clinics, but also throughout the curricula. Domestic Violence Legal Issues Should Be Raised in Core Curriculum Courses Historically, domestic violence issues have not been raised in law school courses or addressed in mainstream legal journals. Traditional law school textbooks do not include domestic violence issues, and many law school professors do not incorporate domestic violence issues into their courses. Failure to address these issues penalizes all students. Regardless of the professional track a student chooses, it is likely that he or she will be faced with legal problems related to domestic violence as a practicing attorney. Since all students will benefit from an understanding of domestic violence issues, it is necessary to incorporate these issues into core curriculum courses.

Extractions: BRIEFING PAPER ON LEGAL ISSUES AND WITNESS PROTECTION IN CRIMINAL CASES Since the Defence can also apply for protective measures under s. 271 it may be that a similar duty to protect witnesses should apply to the Defence. The Code of Conduct for Criminal Work could be amended to include such an obligation. The present statutory definition of "vulnerable witness" places two serious limitations on eligibility for protective measures under the law. Section 271 (12) imposes a two-stage process on applications for special measures to protect witnesses in giving evidence. Only certain narrowly defined persons can be classed as vulnerable under the current statutory provisions. Even if so classified the defence or the prosecution must then persuade the court that there is sufficient cause for protective measures to be applied. The current provisions exclude intimidated witnesses.

Extractions: China's entry into the World Trade Organization (WTO) has posed new challenges to judicial works, especially in the area of intellectual property rights (IPR) protection, court officials said. Courts in Beijing have witnessed an increasing number of cases involving IPR protection in recent years, Zhang Lumin, chief judge of the Intellectual Property Right Division of Beijing High People's Court, said in a recent interview. Overseas-related IPR cases that have been heard and ruled upon in Beijing are increasing, from zero in 1993 to 15 cases in the first 11 months of this year, Zhang said. In 1993, Beijing led the country in setting up a special IPR division in its high and intermediate courts. Since then, 59 overseas-related IPR cases have been heard, according to court statistics. More than 30 intermediary and high courts have set up such divisions around the country, mostly in economically advanced regions, Zhang said. "Faced with the challenges of WTO entry, China is striving to improve its intellectual property legal system to better meet new economic circumstances," Zhang said.

Extractions: Don't slay the bearer of bad news. That's the message Congress sent companies when it finally hammered out a law last summer to curtail corporate misconduct. While the Sarbanes-Oxley Act of 2002 got plenty of media attention, chances are you haven't heard about this provision protecting whistle-blowers, which applies not only to publicly held companies, but also to those who advise them. Corporate scandals and the Time Persons of the Year brought whistle-blowers into the limelight, but the need for you to pay attention to their rights will continue long after the attention has died down. Suppose an employee suspects his or her company is playing fast and loose with its financial reports. Being an upright citizen, he or she reports those suspicions to the federal government. The supervisor catches wind of this and fires the employee. Under the new provisions, that supervisor and company officers could face criminal fines or even jail time for such an action. It doesn't matter whether the employee's suspicions were correct; the key is reasonable belief that there are federal fraud violations.
