The federal Justice Minister is responsible for criminal proceedings under Federal Statutes and for civil proceedings under federal laws. This division means that the majority of prosecutions in Alberta, as well as in the rest of the country, are handled by provincial prosecutors. A Crown prosecutor is a lawyer who is authorized to represent the Crown (i.e. the state) before all courts in the prosecution of offences. The power to lay an information (i.e. a charge) is found in the Criminal Code of Canada . The police have no particular power to lay a charge, but rather the same power as any other individual. In many places the rush is on to remove existing restrictions on freedom of speech and expression, regardless of the consequences! Those skilled in the use of computers, both adults and children, can now transmit graphic pictures of lewd sex acts to other continents within seconds and converse with known sex offenders and child molesters who ask for names and addresses for clandestine rendezvous. Music with lyrics that suggest and encourage suicide and the killing of parents, police, and government officials is now heard daily on radio and television or is on recordings played by children. Few of those demanding unrestricted freedom of speech would disagree with Supreme Court Justice Oliver Wendell Holmes, Jr., who over a half century ago wrote in a famous landmark decision regarding freedom of speech: "The most stringent protection of free speech would not protect a man in falsely shouting fire in a theater and causing a panic." The resulting consequences of such an act are obvious. How unreasonable, then, for these same ones to place little or no value on a subsequent sentence of that same decision and act in headstrong defiance of it. "The question in every case," said Holmes, "is whether the words used are used in such circumstances and are of such a nature as to create a clear and present danger that they will bring about the substantive evils that Congress has a right to prevent."

The reality is that there's nothing in the Constitution and nothing in the law that says-that supports the White House claim that Secret Service agents somehow are not obligated, as all other citizens are, to respond to a lawful subpoena from the-from a court of law. And, if, in fact, the agents had been allowed not to testify, if the courts had decided that they were somehow exempt, then they would have been placed above the law. And, in fact, the Secret Service agents are sworn law enforcement officers. For them to fail to cooperate with a legitimate inquiry by the U.S. Government I think would have done great injustice to our system.

From a humble pilot program involving four students during the 1972-73 academic year, the program now known as "Street Law" has grown to include hundreds of students at over 40 major law schools across the country. In addition, Street Law, Inc., a non-profit group developed in response to the need to expand this program nationwide. The success of the programs in this country has led Street Law Inc. to take Street Law overseas. Currently, programs are being offered all over the world, including South Africa, Chile, Ecuador, German, Namibia, the Philippines, Ethiopia, Bolivia, and Eastern Europe. Street Law is a practical program of legal education designed to engage high school students in a critical examination of their legal responsibilities and rights. By taking law to high schools, law students have the opportunity to conduct discussions with the high school students about practical legal problems, contemporary legal issues, and the ramifications of breaking the law. The ultimate goal of the program is to provide these inner-city students with a sense of belonging in society through empowerment with knowledge of the law. By providing students with a non-adversarial view of the law, Street Law works to provide an understanding of the fundamental principles of authority, fairness, justice and responsibility that underlie our legal system. By demystifying the law, Street Law will hopefully allow young people to develop a positive attitude towards the law and reduce juvenile delinquency.

This is especially true in cases of environmental and health and safety suits, where court actions may be critical to the well-being of individuals, the community and society at large. The role of expert witness provides opportunities for public service and professional development, but it has its dangers. Many people regard expert witnesses as charlatans whose testimony is bought, and who will say anything to get their extraordinarily high fee. The spectacle of two supposed experts vehemently disagreeing on an issue in court only fuels that image. Certain areas of litigation tend to produce "professional" witnesses, but too-frequent testimony from a particular bias can make such an expert appear self-serving. It is vital that scientists improve their effectiveness as witnesses to make the most out of the experience professionally and personally and to bring their best to the judicial process of which they are a part.

Most involve a young couple in which the mother is converted to the Witnesses, severely alienating the father, and resulting in a divorce. Because the non-Witness fighting for custody is typically the father, the author recounted primarily the difficulties encountered in these kinds of cases. The major concern of the fathers is that raising their children as Jehovah's Witnesses is not conductive of achieving the goals that most fathers deem important for their children.
