Extractions: INTRODUCTION Chapter 7 of the UNIDROIT Principles of International Commercial Contracts is significant on at least two levels. In practical terms, it is the substantive heart of the whole Principles. It is where the Principles solutions to a large proportion of real world disputes in commercial transactions are to be found. It is here that the remedial consequences of serious failures of performance are defined: orders of performance, damages, contract termination by rescission, and restitution. These are difficult and central substantive issues. Indeed, Chapter 7 is probably the most imaginative synthesis to emerge in this generation of some of the most difficult practical questions of contract law. It will be a powerful support for the harmonization of actual outcomes and improve the reliability of the often unpredictable results of disputes. The substantive content of Chapter 7 is important as an illustration of the creative power of the UNIDROIT Principles. Chapter 7 is also important as an example of how the Principles work and of their usefulness in the emerging pattern of harmonized international commercial law. Chapter 7 brings closer together the substantive outcomes in courts, arbitral tribunals, and institutions of alternative dispute resolution in different legal systems, thus providing a prime example of how harmonization of international commercial law can improve the law. I have pointed out elsewhere that harmonization is not always the equivalent of substantive reform that improves the operation of the law.
Extractions: Freight forwarders hold an important position in international trade. Traditionally they were mainly engaged in assisting merchants in connection with preparing and booking the cargo for subsequent carriage. In doing so, they would perform a number of services ancillary to the carriage and also contract for carriage as an agent of the merchant. In some cases, freight forwarders would at the same time act as agents for carriers, particularly liner shipping companies for the carriage of goods by sea. The freight forwarding services would also normally include the clearance of the goods for export in the country of shipment and for import into the country of destination. Also, freight forwarders would have co-operating partners in other countries to whom instructions could be given for the receipt of the cargo at destination and for customs clearance. Actions Iceland must carry out so that its whaling operations accord with the international law of the sea. Is it possible for Iceland to reenter the IWC with a reservation to the moratorium? The first and overriding consideration in responding to this question is simply what is the international law for whaling. In my view, under general or customary international law the nationals of all states are entitled to harvest whales on the high seas unless the state of registry or flag has agreed otherwise; each coastal state has control over whales within its national jurisdiction, subject to its international agreements, and it has sole authority over the activities of its nationals on the high seas. I think these propositions accurately state current international law on whaling.
