BACKGROUND As a part of the EU-sponsored project Confidence Building in former Yugoslavia: Reconciliation through direct communication and interaction , a forum is being initiated at which the issue of nationalism can be freely and openly discussed. The complex ingredients which purport to identify differences between the peoples, in terms of their national 'uniqueness' are amongst the most important aspects of the political and social dynamics within the successor states of former Yugoslavia. Examination of the complex relationships which form a raison d'etre and motivation for the processes of self-determination, coupled with major socio-political changes in recent years, presents cross-cultural challenges. AIM The acute problematics of the successor states of Yugoslavia in recent history have made it almost imperative that the first Korcula Summer School/Conference concentrates on national identity versus national enmity. The Conference proposes to examine closely the various strands which define that phenomenon which is understood in colloquial and academic parlance as 'nationalism', taking both a theoretical and empirical approach in addressing the issue.

Bosnia was settled by Serbs in the 7th cent.; it appeared as an independent country by the 12th cent. but later at times acknowledged the kings of Hungary as suzerains. Medieval Bosnia reached the height of its power in the second half of the 14th cent., when it controlled many surrounding territories. Bosnia also annexed the duchy of Hum, which, however, regained autonomy in 1448 and became known as Hercegovina. During this period the region was weakened by religious strife among Roman Catholics, Orthodox, and Bogomils . Thus disunited, Bosnia fell to the Turks in 1463. Hercegovina held out until 1482, when it too was occupied and joined administratively to Bosnia. The nobility and a large part of the peasantry accepted Islam. Extractions: SAILING AROUND THE FLAT EARTH: THE INTERNATIONAL TRIBUNAL FOR THE FORMER YUGOSLAVIA AS A FAILURE OF JURISPRUDENTIAL THEORY INTRODUCTION The court marks an unprecedented effort to enforce against individuals, by an impartial, nonmilitary body, the dictates of international criminal law. But beyond these much-noted innovations, the court constitutes a much more fundamental innovation, one that is yet to be noted. For the court is, by its very nature, a departure from the basic philosophical ideas underlying the modern conception of international law itself. Observers and participants alike have portrayed the tribunal effort as a potential watershed event. The effective assertion of international authority in the criminal realm, a realm traditionally understood to be primarily, if not exclusively, controlled by the law of individual states, would greatly enhance the perceived legitimacy of international law as against traditional notions of state sovereignty. Moreover, a successful court would put to rest any lingering doubts as to whether individual persons may properly be the subjects of international criminal law. On a more practical level, the tribunal would further the goal of a just international order by vindicating the victims of Yugoslavian atrocities and providing a deterrent against future crimes.
