The loving and nurturing relationship between grandparents and a grandchild often provides the child with intangible benefits that cannot be derived from other relationships. Increasingly, however, grandchildren, often the product of broken homes, have been deprived of contact with their grandparents. The legislature and courts, cognizant of the importance of the grandparent-grandchild relationship, have implemented procedures by which grandparents can seek visitation with their grandchildren. These laws, however, do not give a grandparent an absolute or unqualified right to visitation. Instead, as in all cases involving child custody and visitation, the primary inquiry is "what is in the best interests of the children." It is the grandparent's burden to show that it is in the best interest of the child for the grandparent to have visitation. Before the court will even consider whether visitation is in the best interests of the child, the grandparent must show that he or she has "standing" to seek visitation. As written and interpreted in New York, for instance, only a natural grandparent or grandparent through adoption has standing to seek visitation with a grandchild. The statute is severely limited in scope and the New York courts have not been expansive in their construction of this law. For example, it has been held that other family members (e.g., uncles and even great grandparents) lack standing to seek visitation with children. In at least one case, a court held that a natural grandparent, who renounced her parental rights to her daughter, the mother of her grandchild, lacked standing to seek visitation with the grandchild.

GRANVILLE For many people, one of life's great joys is time spent with grandchildren. The traditional grandparent-grandchild relationship provides opportunities for fun and fellowship between the generations. Parents often appreciate relief from child care responsibilities. Grandmother and Grandfather can provide advice and guidance to the grandchildren from a wise and experienced perspective. But when the grandparent-grandchild relationship is disrupted, it often results in heartache for both. When a couple separates or divorces, the courts often play a major role in deciding custody of the children and visitation rights of the non-custodial parent. But a grandparent who has forged a bond with the children may be left out of a court order or a settlement agreement. When spouse dies and leaves small children, the remaining spouse may move far away and/or remarry. Again, the grandparents may be prevented from spending time with the grandchildren. Grandparents of children born out of wedlock may not always be welcome when they wish to visit the child. Disagreement between grandparents and their children may result in a family rift that isolates the grandchildren from their grandparents. Whatever the reason, the result may be tremendous disappointment for grandparents and grandchildren who are not allowed to spend time together.

Extractions: Articles - Grandparents Rights - The state of Georgia recognizes that the relationship with a grandparent is important to a child, and gives the grandparents the right to seek visitation when it is otherwise unavailable to them. This might occur when one parent is deceased, or does not get visitation with the children. The grandparents may file a separate action against the custodial parent to seek visitation rights with their grandchildren. However, because of a recent Supreme Court of Georgia ruling, the legislature had to re-write the statute to eliminate the right of the grandparent to intervene where the grandchild is living with both biological parents in an intact family. The custody of a child cannot be given to someone who is not a biological parent unless it is determined, by clear and convincing evidence, that it would be in the child's best interest to live with a relative other than the biological parent. It is no longer necessary that the parent be found to be unfit. If fitness of a parent is an issue in deciding custody the Judge will sometimes ask for a Guardian Ad Litem to help investigate from the child's perspective and make a recommendation to the Court.

Will it be the same amount of time as the parent would get? Pennsylvania statutes indicate that grandparents may be granted reasonable custodial rights in the following circumstances: a. When parent deceased: If a parent of an unmarried child is deceased, the parents or grandparents of the deceased parent may be granted reasonable partial custody or visitation rights, or both, to the child by the court if it is found that the visitation is in the child's best interest. The more contact the grandparents had with the child before the death of the parent, the more custodial time the grandparents will be given. b. When parents' marraige is dissolved or parents are separated: After a divorce complaint has been filed by a parent or when parents have been separated for 6 months or more, the court may grant reasonable partial custody or visitation rights, or both, to the unmarried child if it is in the child's best interest AND would not interfere with the parent-child relationship. Again, the court will consider the amount of contact between the grandparents and the child previous to the petition being filed. c. When child has resided with grandparents: If an unmarried child has resided with grandparents or great-grandparents for a period of 12 months or more and is subsequently removed from the home by the parents, the grandparents or great-grandparents may petition the court for partial custody or visitation or both. The best interests of the child will be considered and these rights will only be granted if the granting of the rights will not interfere with the parent-child relationship.

"Now state court decisions are all over the map," says AARP attorney Rochelle Bobroff. "There's tremendous confusion, tremendous conflict." While very few family disputes go to court, grandparent advocates say, visitation rights are crucial because most grandparents play an invaluable role in the lives of grandchildren. Prior to 1965, that role was not well recognized, and grandparents who were blocked from seeing their grandchildren, usually by the parents, had no legal right to seek visiting privileges. As divorce rates, out-of-wedlock births and drug use increased, states began passing laws bolstering grandparent rights when parents died, divorced, separated or were jobless or disabled. Now the pendulum is swinging back, and more than a third of the states have narrowed those laws. One reason, says Traci Truly, a Dallas family law attorney and author of "Grandparents' Rights" (Sphinx Publishing, 2001), "was a perception that parents' rights had eroded." Contents Overview When you are filing for divorce, or if a divorce has been filed againt you, you will find that there are a wide range of attorneys who practice family law, and that the fees can vary enormously between law offices. The cheapest attorney is rarely the best, but in an amicable divorce you may find that all you really need is an attorney who won't stand in your way while you negotiate a settlement. You don't need to spend a lot on an attorney, if you are in agreement on custody and property issues. When there are disagreements, choose your attorney carefully. If possible, get references from people you know who have recently divorced. As family law is very stressful, a great many attorneys do not practice in the area, and as a consequence it is relatively easy for attorneys with little skill or experience to develop a family law practice. While the most expensive option is not necessarily the best, when faced with contested divorce or custody litigation there is some truth to the old saying, "You get what you pay for." If you try to save money by hiring the cheapest attorney you can find, you may well learn that you gave up more in property, spousal support, or rights to retirement benefits than you "saved" by hiring the wrong lawyer for your case.
