In that case, the Court of Appeals examined the admissibility of DNA evidence. In her opinion, Chief Justice Kaye noted (at pg. 437, note 4) that '[i]t is not for a court to take pioneering risks on promising new scientific techniques, because premature admission both prejudices litigants and short-circuits debate necessary to determine the accuracy of a technique.'" [Trish's note: Contrary to claims made by Gardner and members of the Fathers' Rights movement, the Frye test had NOT been applied in the Florida case Kilgore v. Boyd. The judge relied primarily on "expert" testimony made by Gardner and Richard Warshak, a noted fathers' rights apologist and supporter of Parental Alienation Syndrome. The syndrome had not been forced to withstand any valid testing.]

The answer is: Women take the time and make the effort to learn how the family law system works, MEN DON'T! It's that simple! Men are their own worst enemy. A man's failure to learn the simple steps he can take to win (or improve) his case will only result in greater failure. Take the time to learn the rules before you play the game! Yet Ken Gallahan could conceivably remain in jail for the rest of his life. What is his infraction? He does not have $15,000 to pay a lawyer he never hired. He was already jailed indefinitely when he could not pay a psychotherapist he also had not hired and was released only when his mother paid the fees. Debtors' prisons were theoretically abolished long ago, but this does not stop family court judges from using the bench to shake down fathers who have done nothing wrong and funnel everything they have into the pockets of the court's cronies. In fact the looting and criminalization of fathers like Ken Gallahan is now routine in divorce courts.

It handed down this decision in July 1997. This is the place you go to appeal against a decision of a single Family Court judge. At the Full Court, three judges make the decision. In this case one of them was the Chief Justice of the Family Court, Justice Alastair Nicholson. What's this case about?

Some cybergroups, like the Fathers' Manifesto, actively recruit members and spread misinformation there. The Manifesto is an umbrella organization founded by John Knight Men's Action Network (MAN), seeks to define the new male rights as "safeguards" and to devalue women's rights by referring to the "radical cultural philosophy that sees men as the enemy, regards the traditional family as a tool to oppress women and sees every male-female relationship as a power struggle."

That notice did not actually run, but under a one-of-a-kind state law, Florida now requires women who don't know the birth father of their child to purchase similar ads in newspapers detailing their sexual histories before giving a baby up for adoption. The ads must run once a week for four weeks in a newspaper in the city where the child may have been conceived. The statute's backers say its goal is to provide birth fathers every opportunity to take responsibility for their children and prevent painful custody battles that can break up adoptive families. Critics of the adoption law, which took effect last October and applies only to private adoptions, say it invades privacy and brands women with a "scarlet letter" by making them divulge embarrassing intimate sexual details. Six women hoping to get the measure abolished are planning a lawsuit to be filed later this month in West Palm Beach, Fla.
Extractions: Site Map Welcome to PaternityNet Welcome! After spending over eight years helping divorcing and divorced parents at DivorceNet.com , we wanted to provide a similar service to parents who challenge the paternity of their children. Here you can research both the law and science of paternity. Your situation is far from unique, out-of-wedlock births are now commonplace. In fact, paternity cases outnumber divorce filings in many courts. If the alleged father signs a voluntary acknowledgment of paternity, the courts don't have to decide parentage, but custody, visitation and child support often remain at issue. However, if legal paternity is at issue, i.e. the alleged father (and sometimes the mother) denies paternity, the parent who wishes to establish paternity must bring a paternity suit or action. Unlike more conventional legal cases, contested paternity actions are decided primarily on the scientific evidence of DNA testing. Therefore, if biological fatherhood is in question, your first step is to conduct a paternity test. If parents can't agree to the test, the court will order it. These genetic test results are often conclusive, although courts often allow contradicting evidence, such as proof that the alleged father had no physical access to the mother at the time of conception.
Open Letter To Fathers Rights Movement C) fathers rights leaders engage in a campaign of public disinformation about family law matters including child support enforcement standards, custody http://nafcj.org/openletter.HTM
Extractions: NATIONAL ALLIANCE FOR FAMILY COURT JUSTICE OPEN LETTER TO ALL MEMBERS OF THE FATHER RIGHTS MOVEMENT By Liz Richards In response to questions and concerns from father rights leaders about complaints from myself and others representing litigating mothers and family abuse victim, I would like fathers rights movement principals to respond to the following: A). Fathers Rights organizations have introduced into official proceedings inappropriate psychological standards meant to produce false negatives in child sex abuse litigation for the benefit of male sex offender. No professional body has endorsed the Gardner-PAS methodology as an appropriate standard in any family law forum. B) In fact most professionals are highly critical of this and similar standards created to deliberately discredit female complaints about male family violence offenders, promoted by fathers rights allies such as Gardner, Underwager, Farrell and more recently Braver. These are contrived standards for protecting male offenders from the law, and allowing them to continue their unlawful injurious conduct. C) Fathers rights leaders engage in a campaign of public disinformation about family law matters including child support enforcement standards, custody litigation, maternal conduct in domestic disputes and other issues. They do this for the sole purpose of confusing the public and lawmakers to achieve for themselves recognition as a "special class" on the grounds of acutevictimization by society and the legal system. Fathers rights literature discredits some of their own most widely disseminated claims, such as (i) widespread and extreme legal system bias against men in custody disputes (ii) automatic disenfranchisement of their parental relationships, (iii) frequent patterns of false allegations of child abuse made deliberately by vengeful women, and (iv) routinely blaming of men for family violence acts they disavowy that they did not commit, and (v) routine assessment on men of child support beyond their ability to pay.
Extractions: Family Question 84: How do I terminate my fathers rights to me. I have not seen him in three years. I want my step dad to adopt me. Answer: Although you have not seen your father in three years, is he paying child support or has he kept in touch with you in some way? This is important because if he has not paid support or called or sent letters, etc., there may be grounds to terminate parental rights on the basis of abandonment. To do this a petition for termination of parental rights would need to be filed with the juvenile court and your father would have an opportunity to challenge it. The easiest thing to do would be for your mother to ask your father to voluntarily give up his parental rights. Then you would be free to be adopted, if that's what your step-father and mother agree it is best for you.
