The purpose of the written procedure Regardless of the nature of the proceedings (direct action or reference for an advisory opinion), the purpose of the written procedure is always the same, viz. to put before the Court an exhaustive account of the facts, pleas and arguments of the parties and the forms of order sought. Indeed, the written phase of the proceedings is the principal part of the case before the EFTA Court; the oral hearing serves merely as an opportunity to supplement the written pleadings and answer or rebut arguments from other parties or interveners that have not been addressed in the written pleadings. Consequently, it is important to focus considerable effort and reflection on the written observations. It is important to note that the entire procedure before the Court, in particular the written phase, is governed by the principle whereby new pleas may not be raised in the course of the proceedings, with the sole exception of those based on matters of law and fact which come to light in the course of the procedure (Article 37(2) RP).

These rules establish a uniform process for trying cases and ensure that justice is fairly administered throughout federal, state, and local court systems. Separate sets of procedural rules exist for each jurisdiction. Within a specific jurisdiction, different sets of rules govern different types of cases. For example, separate rules exist for civil cases, criminal cases, and juvenile cases. Other rules govern appellate cases. In addition, individual courts ( e.g ., U.S. Supreme Court) frequently have their own local procedural rules. Procedural rules are mandatory. If they are not properly followed, courts may refuse to hear a case or may impose sanctions on errant parties.
