SOME CONNECTICUT DUE PROCESS CASES PERTAINING TO ABA FUNDING As of 11/97 there were three Connecticut legal decisions pertaining to the issue of whether Applied Behavior Analysis (ABA) based services are the most appropriate educational intervention for children with autism spectrum disorders. All three decisions involve claims against school systems. To date, there has been no Connecticut ABA case against the Birth to Three system that has gone all the way to hearing. The first decision is called In Re Child With Disabilities, No. 95-301, (11/20/95) and was decided in favor of the parents. The decision is believed to be against the town of Middletown (certain aspects of these decisions, such as the identities of the parties, must be kept confidential under the law). The Hearing Officer in that decision, Edward Pepyne, is a lawyer.
