The application of the death penalty is very patchy with two states, Texas and Virginia accounting for more than half of all executions whilst six retentionist states have had no executions since 1976 and seven of these have 5 people, or less, on death row. New Hampshire is the only one of these to have no one on death row. It is the ultimate cruel, inhuman, and degrading punishment. In , the United Nations adopted the Universal Declaration of Human Rights. The Declaration, adopted without dissent, is a pledge among nations to promote fundamental rights as the foundation of freedom, justice, and peace in the world. The Declaration proclaims each person's right to protection from deprivation of life, and it categorically states that no one shall be subjected to cruel or degrading punishment. The death penalty the pre-meditated and cold-blooded killing of prisoners in state custody violates both of these rights. In In In In , the United Nations General Assembly adopted the Second Optional Protocol to the International Covenant on Civil and Political Rights Aiming at the Abolition of the Death Penalty. It binds the states that are parties to it not to carry out executions and to abolish the death penalty.

Extractions: Amnesty International is opposed to the death penalty in all cases. However, the execution of children is particularly outrageous. International standards exempt children from the death penalty, not to excuse their crimes or to belittle the suffering of their victims, but in recognition of their immaturity and capacity for change. As a principled message of hope, international standards call upon governments to respond to child offenders by maximizing the potential for their eventual successful reintegration into society. The Death Penalty An essay that considers capital punishment to be inhumane. The foundation for the this thesis is that a criminal suffers the same way an innocent person suffers, and in that context to cause suffering without purpse, especially when a jail is sufficient to protect the public, is humane. http://www.punkerslut.com/articles/deathpenalty.html

Like abortion, it is a hotly debated issue. The primary problem with the Death Penalty as it stands today is that it results in executing many innocents. In 1915, Joe Hill was executed and was later proven innocent. There are obviously major flaws with the system as it stands. To quote a qualified source in regards to Capital Punishment... Whether you support or oppose capital punishment, there is mounting evidence that the system is broken. A review of death penalty judgments over a 23-year period found a national error rate of 68 %. In a matter of life and death, we are getting it wrong more than 2 out of every 3 times. We need a moratorium on executions to give us time to figure out why the system is not working. [*1] *1. ACLU.

The Supreme Court has ruled that the death penalty is not a per se violation of the Eighth Amendment's ban on cruel and unusual punishment. Furthermore, the Sixth Amendment does not require a jury trial on the sentencing issue of life or death. In the landmark case, Coker v. Georgia, 433 U.S. 584 (1977) , the Supreme Court ruled that the death penalty is a grossly disproportionate punishment for the crime of rape of an adult woman. The Court came to this conclusion by considering objective indicia of the nation's attitude toward the death penalty in rape cases. At the time, only a few states allowed for executions of convicted rapists. More recently, in Atkins v. Virginia
Open Hand Capital Punishment Page Facts, arguments and essays against the death penalty. http://www-personal.umich.edu/~spragge/capital.html
Extractions: Capital Punishment: Facts and Arguments This page aims to discuss capital punishment as rationally as possible. I propose to present information which may help people make up their minds about whether or not capital punishment keeps them safe, makes economic sense, or provides a satisfactory "closure" for the victims of homicide. How, if at all, this information affects your response, either emotional or political, to capital punishment remains entirely up to you. The questions of fact concerning capital punishment fall into three general areas: does capital punishment save money , freeing social resources for better purposes than warehousing and feeding murders, or does it actually cost more, consuming resources that could go into preventing crime? Does capital punishment strike fear into offenders, saving innocent lives by deterring would-be killers? And, finally, the courts make mistakes; what does capital punishment mean to an innocent person wrongly accused These questions fit together to define a complex problem. If experience showed capital punishment saved lives by deterring offenders, the cost would not matter; a certainty that capital punishment would save innocent lives might even make the risk of wrongful convictions acceptable. If no risk at all existed of an error by the courts, the question of whether capital punishment saves innocent lives by deterring murder might matter less. And we cannot limit the cost of capital punishment simply to money, since society has limited resources, and can only spend so much on criminal justice. A society that spends money on executions can't spend that money on police officers, courts, or jails; to say nothing of schools, vocational programs, or other measures aimed at preventing crime.

He would support mandatory review of all death penalty sentences. "I'll tell you, I'm uneasy about the death penalty," Clark said answering a question recently in Arkansas. "A government like the United States has the right to, in extraordinary cases, take the life of a criminal, but I don't like the way the death penalty has been applied in America," Clark said. "I think it's been applied in an unfair and discriminatory fashion and I think we need to go back and use modern technology and unpack all those cases on death row."
