Democrats said the school choice proposals amounted to a dangerous expansion of the voucher program. The proposals were a major point of contention in the debate over reauthorization of the Individuals with Disabilities Education Act. The bill passed by a 251-171 vote. One plan would have enticed states to create private school options so parents could use public money for tuition and transportation. A second proposal was intended to give certificates of public dollars about $1,400 to disabled children already enrolled in private schools so they could get extra services. Supporters said that amounts to the per-student federal dollars that school districts receive for special education. Almost every Democrat and about one-fifth of Republicans joined to reject the ideas.

Ed Case's amendment to the Individuals with Disabilities Education Act (Star-Bulletin, April 22), which would base attorneys' fees for representing disabled students on rates set by the governor of each state. Apparently I have more confidence in our court's discretion than Case does. One wonders why the attorney general's lawyers representing the DOE are not prevailing. Perhaps the governor should seek legal advice from the private sector. The federal government, which updated IDEA in 1997, must cover a substantially higher percentage of the costs. Case would do well to redirect his carte blanche issue toward the feds who need to provide more financial support.

And these are just the kids the districts are already aware of. Schools are just beginning to see the wave of these children. As more and more special-needs children enter public school, they join those already enrolled: in the next few years, schools will be inundated with them. The article announced that the problem of educating children with autism in the public schools has grown so severe that Goleta Union School District is considering establishing a special class next year just for students with autism. For 10 years, school districts all over the country have been working toward full integration of students with disabilities, regardless of severity, in regular, age-appropriate classrooms. But the instructional and management difficulties presented by some students with disabilities notably those with autism impose new challenges on schools to meet the extraordinary needs. The News-Press article indicates that a fairly sudden increase in the number of students with autism is forcing the issue in a way that severely limits options for schools, like Goleta's, that are facing ever greater resource constraints.

The student was diagnosed with Tourette's Syndrome, and various behavior disorders including attention deficit hyperactivity (ADHD) for which he is prescribed medication. Education Code sec. 56381 provides that reassessment of students eligible for special education shall be conducted at least every three years. In this case, the last triennial assessment occurred almost three and a half years ago. A lack of evidence regarding serious behavior problems due to a change in the pupil's medications also required that a new mental health assessment (AB 3632) be performed. However, the assessment did not have to be conducted by a Tourette's specialist. No factual or legal support was presented by the parents to support this request, and County Mental Health had a board-certified child and adolescent psychiatrist experienced in working with children with ADD.
