Extractions: Site Index Issues in Ethics - V. 8, N. 3 Summer 1997 Law students reflect on the principles they intend to follow in their professional lives By Richard J. Heafy In 1996, while teaching a course on ethics to Santa Clara University law students, I asked the members of my class to write a brief statement of their moral principles. They were under no compulsion to please their teacher. I told them they could either sign the submission or not, and the exercise was ungraded. The situations in which a lawyer's personal values conflict with his or her professional responsibilities are easy to list, and they never fail to stimulate thoughtful discussions among students: defending the guilty or prosecuting the innocent; limiting the liability of a willful and reckless polluter; using the legal process to wear down competitors or other adversaries; or asserting a dubious privilege solely to conceal damaging evidence. And the list could go on. But is that a cop-out? Like an employer who justifies exploiting workers or making a substandard product by invoking the morality of the marketplace, a lawyer who says he or she is just filling a role in a system that produces justice is also abdicating responsibility. Narrow professionalism leaves little room for promoting personal values or the public interest since these considerations are often trumped by the lawyer's duties of confidentiality and loyalty to the client.

Here at , the holiday combined with a quick trial in San Diego and a sudden rush of interesting appellate decisions, giving rise to one of the most prolific posting periods we've yet seen. The eight posts following this one are all new since the pre-Thanksgiving Wednesday. Of that group of new cases, the one most likely to have long-term impact is the wholesale revision of California punitive damage law, summarized here Briefly noted, other sites with notable post-holiday developments: Ken Lammers' CrimLaw weblog has received a tasteful (and more easily readable) makeover, and continues to be your one-stop source for the latest in Beltway Sniper news. Extractions: Download .pdf version of Guide Researching issues in professional responsibility is a complex process and requires use of materials beyond judicial decisions and statutes. At the core of issues of legal ethics are the rules governing the conduct of lawyers and judges that are adopted by each state. These state rules are based on model rules adopted by the American Bar Association, most recently the Model Rules of Professional Conduct and the Code of Judicial Conduct. In addition, each state bar association has some mechanism for enforcing the rules through disciplinary proceedings and through the issuance of opinion letters on ethical issues submitted to it. You may need to consult bar association ethics opinions, the Model Rules, and the version of the rules of professional conduct for your particular state. Case law research can also be complicated because ethics issues can arise from attorney discipline proceedings and such diverse substantive areas as legal malpractice and criminal appeals. This research guide concentrates on materials other than case law, although a few tips on finding judicial decisions in the area of legal ethics are included. GETTING STARTED If you need some background on professional responsibility or an overview of key issues, start with the hornbook
