During each of Rocker's many games at Shea Stadium, a war has raged between him and the fans. As he walked onto the field, fans would hit him with everything from beer to batteries to bottles to quarters, and he would respond with ridiculous antics, which included spitting at Mets fans, flipping fans the middle finger and throwing balls at the net separating the fans from the field.

Baseball commissioner Bud Selig made his decision under the "best interests of baseball" clause, which allows him industrial powers of which other monopolists can only dream. Listen to Selig's sermon: "Major league baseball takes seriously its role as an American institution and the important social responsibility that goes with it. We will not dodge our responsibility. In fact, Mr. Rocker has become a hero to thousands of non-New Yorkers who have made him a digital poster boy for on-line racists, bigots and New York-haters. For example, at Stormfront.org, the Webs largest and oldest white supremacist organization (now theres a claim to fame!), chat rooms are buzzing with hundreds of tributes to Mr. Rocker, who made news in December by castigating New Yorks gays, immigrants and single mothers. One chat room participant wrote a poem entitled "Off Your Rocker?" The poems sentiments can be summed up in four lines: "So you think that the countrys becoming/ A little bit over-exotic./ If you were a baseball player,/ Theyd suspect that you were psychotic." And, yes, his "apology" interview with Peter Gammons was as convincing as an aging totalitarian dictator's concern for human rights. Nevertheless, the 30-day suspension ordered by Major League Baseball Commissioner Bud Selig raises very troubling questions ethical as well as legal. In fact, there are two distinct issues involved. First, can Selig take any disciplinary action for offensive statements made after the season concluded and not in any official capacity? If so, then is the punishment excessive as compared to other disciplinary rulings? The MLB Players' Association has filed a grievance and an arbitrator will make the determination. The second question is easier. All the arbitrator has to do is to compare this punishment for a statement, not an action with other determinations. Rocker's suspension, the longest in modern times for a non-drug offense, becomes severe in comparison with other recent actions. When Roberto Alomar spat at an umpire, his suspension was five games (served at the beginning of the next season who he would not miss a playoff game). When Albert Belle assaulted a fan by throwing a ball in his chest, his sanctions was seven games. Both more egregious in that they involved improper physical harm while the player was at work. In Rocker's case, baseball wanted to make a "statement" in enacting this punishment. I can easily see the arbitrator concluding that the "statement" was excessive.
